The following terms and conditions apply to all bookings for Private classes, courses, seminars, retreats, and competitions offered by Moehnke Training Academy (the “Academy”). By booking any of the Academy’s services, you agree to be bound by these terms and conditions.

Booking and Payment
1.1. To book a place at a public course, seminar, retreat, or competition, you must complete the online booking form and pay the full fee in advance. You will receive a confirmation email with the details of your booking and payment receipt.
1.2. To book a private or in-house course, seminar, retreat, or competition, the Academy will manually approve or deny requests to agree on the date, time, location, and fee. You will receive a booking confirmation email.
1.3. The Academy reserves the right to cancel or reschedule any of its services due to unforeseen circumstances, such as low enrollment, instructor illness, or adverse weather conditions. In such cases, you will be notified as soon as possible and offered an alternative date or a full refund.
1.4. The Academy reserves the right to change the content, format, or instructor of any of its services without prior notice, provided that the quality and learning outcomes are not compromised.

Cancellation and Refund
2.1. You may cancel your booking for any of the Academy’s services by sending a written notice to the Academy at least 14 days before the start date of the service. You will receive a full refund of the fee paid, minus a 10% administration charge.
2.2. If you cancel your booking less than 14 days before the start date of the service, or fail to attend the service without prior notice, you will not be entitled to any refund. However, you may transfer your booking to another person, subject to the Academy’s approval and availability.
2.3. If you are dissatisfied with the quality or delivery of any of the Academy’s services, you must inform the Academy in writing within 7 days of the end date of the service, stating the reasons for your complaint and the remedy you seek. The Academy will investigate your complaint and respond to you within 14 days, offering a suitable solution, such as a partial refund, a credit note, or a repeat of the service.

Liability and Disclaimer
3.1. The Academy will use reasonable care and skill to provide the services as described on its website and promotional materials. However, the Academy does not guarantee that the services will meet your expectations, requirements, or objectives, or that you will achieve any specific results or outcomes from attending the services.
3.2. The Academy will not be liable for any loss, damage, injury, or expense that you may suffer or incur as a result of attending the services, except in cases of negligence, fraud, or breach of contract by the Academy.
3.3. The Academy will not be liable for any indirect, consequential, or special damages, such as loss of profit, loss of opportunity, loss of goodwill, or loss of data, arising from or in connection with the services or these terms and conditions.
3.4. The Academy’s total liability to you under these terms and conditions will not exceed the amount of the fee paid by you for the service in question.

Intellectual Property Rights and Confidentiality
4.1. The Academy owns and retains all intellectual property rights in the content, materials, and methods used or provided in the services, including but not limited to course manuals, handouts, slides, exercises, case studies, and assessments (the “Materials”). You may not copy, reproduce, distribute, modify, or create derivative works from the Materials without the Academy’s prior written consent.
4.2. You may use the Materials for your own personal or professional development, but you may not use them for any commercial or competitive purposes, or share them with any third parties, without the Academy’s prior written consent.
4.3. You agree to keep confidential any information that you may obtain or receive from the Academy or other participants in the course of attending the services, and not to disclose or use such information for any purpose other than for your own personal or professional development unless required by law or with the Academy’s prior written consent.

General 5.1.
These terms and conditions constitute the entire agreement between you and the Academy with respect to the booking and provision of the services and supersede any previous agreements, communications, or representations, whether written or oral.
5.2. These terms and conditions are governed by and construed in accordance with the laws of Canada, and any disputes arising from or in connection with them will be subject to the exclusive jurisdiction of the courts of Canada.
5.3. The Academy may assign or subcontract any of its rights or obligations under these terms and conditions to any third party, without your consent. You may not assign or transfer any of your rights or obligations under these terms and conditions to any third party, without the Academy’s prior written consent.
5.4. If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable by any court of competent jurisdiction, such provision will be severed from the rest of the terms and conditions, which will remain in full force and effect.
5.5. The Academy’s failure or delay to exercise or enforce any of its rights under these terms and conditions will not constitute a waiver of such rights, nor will it affect the validity or enforceability of any other provision of these terms and conditions.
